Terms of Service

Welcome to Tapes. These Terms of Service ("Terms") govern your access to and use of the Tapes mobile application and related services (collectively, the "Service") operated by Jeffrey Asante ("we", "us", or "our"), based in Accra, Ghana.

By downloading, installing, or using Tapes, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Tapes application on devices you own or control, solely for your personal, non-commercial purposes.

Restrictions: You may not (i) copy, modify, or distribute the application; (ii) reverse engineer, decompile, or disassemble any part of the Service; (iii) rent, lease, or lend the application to third parties; (iv) use the Service for any unlawful purpose.

2. Your Content

Ownership: You retain full ownership of all audio recordings, projects, metadata, and other content you create or import into Tapes ("Your Content"). We claim no intellectual property rights over Your Content.

License to Operate: By using the Service, you grant us a limited license to process Your Content solely as necessary to provide the Service's features (e.g., local storage, format conversion, AI analysis). This processing occurs entirely on your device.

Responsibility: You are solely responsible for ensuring you have the legal right to use, process, and store any audio content you import into Tapes.

3. On-Device Processing

Tapes includes advanced features such as AI Stem Separation, Audio-to-MIDI Conversion, Vocal Denoising & Dereverb, Key and BPM Detection, and Format Transcoding.

All processing occurs locally on your device. Your audio files are never uploaded to external servers. We do not use Your Content to train any machine learning models.

4. Subscriptions & Payments

Tapes Pro: Certain features require a paid subscription ("Tapes Pro"), available as monthly, annual, or lifetime purchase options.

Billing: Subscriptions are billed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase.

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your device's App Store settings.

Refunds: All purchases are processed by Apple. Refund requests must be directed to Apple in accordance with their policies.

5. Acceptable Use

You agree not to use the Service for any illegal activity or to infringe third-party rights, attempt to gain unauthorized access to any part of the Service, interfere with or disrupt the Service's integrity or performance, use the Service to process content you do not have rights to, or redistribute, resell, or commercialize the Service without authorization.

6. Intellectual Property

The Tapes application, including its design, code, user interface, graphics, logos, and trademarks, is owned by Jeffrey Asante and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We make no guarantees regarding the accuracy of AI-powered features such as stem separation, transcription, or audio analysis.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, RECORDINGS, OR CREATIVE WORK, LOSS OF PROFITS OR REVENUE, CORRUPTION OR DELETION OF FILES, OR DEVICE MALFUNCTION OR DAMAGE.

IMPORTANT: Tapes stores data locally on your device. We cannot recover data if you delete the app or lose your device. Always maintain backups of your important work.

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

9. Data Protection

We are committed to protecting your privacy. Please review our Privacy Policy for details on how we handle personal information.

For users in the European Economic Area, United Kingdom, or other jurisdictions with data protection laws, we comply with applicable regulations including GDPR principles.

10. Termination

By You: You may stop using the Service at any time by deleting the application from your device.

By Us: We reserve the right to suspend or terminate your access to the Service if you violate these Terms. Since the app operates offline-first, termination primarily applies to subscription access and App Store distribution.

Upon termination, your license to use the Service ends immediately. Provisions that by their nature should survive (including ownership, disclaimers, and limitations of liability) will remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the courts of competent jurisdiction in Accra, Ghana.

12. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the application or by other reasonable means. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
